Provider Terms

These Provider Terms are an agreement between you, a business or individual offering party rentals or related services on HOPS24 (a "Provider"), and Immobackup UG, Immobackup UG, Dönhoffstraße 11, 10318 Berlin, Germany ("HOPS24," "we," "us," or "our"). They supplement our Terms of Service, which also apply to you. If these Provider Terms conflict with the Terms of Service, these Provider Terms control for your use of the Platform as a Provider. Effective date: 2026-10-05.
1. Free Listings, No Commission
- Creating a Provider account and publishing listings is free. HOPS24 charges no commission, booking fee, or transaction fee.
- Customers pay you directly in the way you agree with them. HOPS24 does not collect, hold, or pay out any money for you and does not issue invoices to your customers on your behalf.
- You may optionally purchase a paid Partner API plan, for example for website widgets without the HOPS24 notice and with an inquiry form, or to connect your own software. Paid plans arise only from an express order and are governed by the Partner API Terms. Your free Provider account is never switched to a paid plan automatically.
2. Marketplace Model and Your Relationship With Customers
HOPS24 brings Providers and Customers together. Any contract for a rental, delivery, setup, staffing, long-term placement, or sale is made directly between you and the Customer. You are responsible for your own contract terms, including price, deposits, payment, cancellation and refund policies, and damage rules. HOPS24 is not a party to that contract and is not your agent, employer, or partner. You are an independent business.
The Platform may help you organize inquiries, bookings, and payment notes that you record yourself. These records do not replace your own accounting, and any export is not an invoice, receipt, or payment confirmation issued by HOPS24.
3. Registration and Accurate Information
You must provide complete and accurate information about your legal or business name, address, contact details, and services, and keep it up to date. You must be at least 18 years old and authorized to bind your business. If you offer rentals as a business, you must register as a business account and may not use a personal account for business purposes.
4. Your Responsibilities
You are solely responsible for your equipment, services, staff, and business. In particular, you agree to:
- Accurate listings: keep listings truthful, complete, and current, including descriptions, photos, dimensions, capacity and age limits, power and space requirements, prices, fees, delivery area, and availability. Do not advertise hidden fees or misleading prices.
- Licenses and permits: obtain and maintain all business licenses, registrations, permits, and inspections required where you operate, including any required by your state or local government for inflatable amusement devices, water slides, amusement rides, tents, food concessions, or electrical equipment.
- State inflatable and amusement device rules: comply with all state and local laws that apply to inflatable amusement devices and similar equipment. Requirements vary significantly by state and may include registration, annual inspection, operator training, signage, insurance minimums, and incident reporting. It is your responsibility to know and follow the rules in each place you operate.
- Insurance: maintain liability insurance appropriate for your business and the equipment and services you offer. We recommend that you provide customers, upon request and where customary, with a certificate of insurance and, where appropriate, name the customer or venue as an additional insured.
- Safety: use equipment that is in safe condition, properly maintained, and not subject to an unremedied recall; follow manufacturer instructions for setup, anchoring, blower use, weather and wind limits, and capacity; give Customers clear operating and safety instructions in good time before the event; and do not deliver or set up equipment where conditions are unsafe.
- Staffing and entertainers: appropriately select, train, and supervise your employees, operators, and entertainers, including performing background checks where required by law or customary for work around children, and comply with employment and labor laws.
- Taxes: you are responsible for all taxes on your business, including collecting and remitting any sales or use tax on your own rentals and services as required by state and local law, and income taxes. HOPS24 does not collect or remit taxes on your rentals.
- Customer data: use customer contact information received through HOPS24 only to respond to and fulfill that customer's inquiry or contract, protect it appropriately, and comply with applicable privacy, anti-spam (CAN-SPAM), and telemarketing (TCPA) laws. Do not add customers to marketing lists without any consent required by law.
- Performance: perform each confirmed booking as agreed, and tell the Customer as early as possible about changes, cancellations, or problems. We recommend responding to inquiries within two business days.
- Documentation: we recommend keeping records such as photos of setup and handover, which may help you resolve disputes.
5. Your Content and License to HOPS24
- Your rights. You represent that you own or have all necessary licenses for every photo, video, text, logo, and other content you upload ("Provider Content"), and that it does not infringe anyone's rights. Do not use manufacturer images, stock photos, or images from other websites without a license. Do not show identifiable people in photos or videos without their consent.
- License. You grant HOPS24 a non-exclusive, worldwide, royalty-free, transferable, and sublicensable license to host, store, reproduce, adapt (for example resize, reformat, or convert videos), display, and distribute your Provider Content to operate and promote the Platform, including on our website, in our emails and marketing channels, through website widgets and the WordPress plugin, and through the Partner API as described in Section 6.
- Duration. The license ends when you delete the content or your account, except for reasonable periods needed to remove it from caches, partner displays (within 24 hours), and backups, and except where we must retain it by law.
6. Display Through the Partner API and Widgets (Partner Feed) – With Opt-Out
- What is shared. We may make the public information of your active listings available through our Partner API to businesses that have accepted our Partner API Terms ("Partners") and display listings on their own websites or apps (for example event portals, venue directories, or rental software). We share only: title, description, photos, category, prices, technical details, city and an approximate ZIP code area, availability (booked dates without reasons), average rating, and your business or display name.
- What is not shared. We do not share your email address, phone number, or full address with Partners. Customers who inquire through a Partner are routed to you only through HOPS24; the inquiry appears in your inbox labeled as a partner inquiry.
- Partner obligations. Partners must link each listing to its HOPS24 page (on Free and Starter plans also with the notice "via HOPS24"), must not alter listing content in a misleading way, must not resell the data, and may cache it for no more than 24 hours. Changes you make on HOPS24 take effect at Partners within 24 hours.
- No cost. The partner feed is free for you, and we charge no commission on partner inquiries.
- Opt-out. You may opt out of the partner feed at any time, without giving a reason and without any effect on your other use of HOPS24, by selecting "Do not show my listings through partner interfaces" under "Partner interfaces" in your profile. We implement the opt-out promptly and no later than 24 hours.
- Your own API use. If you use a Partner API account yourself, for example to connect your own software or to buy a widget plan, the Partner API Terms also apply. You can revoke any software provider's or Partner's access to your account at any time, and access will be blocked promptly.
7. How Listings Are Ranked
We want you to understand how listings are ordered:
- Search, category pages, and Partner API queries: which listings appear depends on the filters selected by the user (such as category, country, city or delivery area, date and availability, and other features). The order depends on the sort option selected: "Distance" (distance between the location stored in your profile and the searched location; the default when a location is searched; listings without a stored location appear at the end), "Newest" (date the listing was created; the default when no location is searched), or "Price" (lowest stated event price first; listings without a price appear at the end). If values are equal, the newer listing comes first. The Partner API uses the same sort options.
- Home page: featured listings are selected by average published rating, then by number of reviews, then by creation date. If a visitor shares their location, the nearest listings are shown instead. Background images are chosen at random from active listings with photos.
- Other pages: city pages and sale pages show the newest listings first. A Provider's own page groups listings by category and, within each category, by how recent they are.
- Weighting: these criteria are not combined into a score; they are applied in the order described. Distance comes first in location searches because equipment and services are delivered locally; ratings serve as a quality signal on the home page; creation date breaks ties. There is no paid placement. Payments to HOPS24 (for example for Partner API plans) and verification badges have no influence on ranking.
8. Reviews and Replies
- Customers can review you only if they inquired through HOPS24, you marked the inquiry as a booking, the event date has passed, and the Customer agreed to a review invitation. One review is possible per booking. Self-reviews are not possible.
- Reviews (star rating, text, the Customer's chosen display name, and the event month) are published on the listing and on your Provider page. The average rating may also be shown through the Partner API and widgets.
- You may publicly reply to each review. You cannot hide or delete reviews yourself.
- You must not write reviews of your own business or a competitor's, or have anyone do so; offer customers money, discounts, refunds, gifts, or anything else of value for a review; condition any benefit on a positive review; or threaten, intimidate, or pressure customers to change or remove a review. These practices may violate the FTC Rule on Consumer Reviews and Testimonials (16 CFR Part 465) and other laws.
- The HOPS24 team hides a review only with a documented reason, for example because it contains unlawful content, harassment, false statements of fact, or personal information of others. We do not hide reviews because they are negative. Hidden reviews do not count toward the average. If you believe a review violates our rules, report it to info@hops24.de and explain why.
- If you delete a booking, a review already given for it remains. Reviews are deleted together with the listing.
9. Verification Badges
- You may voluntarily upload documents such as proof of liability insurance, a permit or inspection record for inflatable devices, or a business license. These files are never published; only you and the HOPS24 team can see them.
- After our team reviews a document, we may display a badge showing the type of document and, where applicable, its expiration date. Not uploading documents has no disadvantage for using the Platform and does not affect ranking.
- A badge means only that a document was presented to and reviewed by our team at a particular time. It is not a guarantee, certification, or endorsement of your insurance coverage, legal compliance, equipment condition, or safety, and you must not describe it as such. You must remove or update documents that expire or are no longer accurate.
- Where required by law or where we have concrete indications of safety issues or false information, we may request appropriate documents in individual cases, limited to what is necessary for that purpose.
- Uploading forged, altered, or expired documents is a serious violation and may lead to immediate suspension.
10. Prohibited Content and Conduct
In addition to the prohibited conduct in the Terms of Service, you may not:
- list equipment that is unsafe, recalled, not permitted, or that you are not authorized to rent or sell;
- post forged or false certificates, permits, inspection records, or insurance information;
- advertise misleading prices or hidden fees, or bait-and-switch offers;
- post content that is infringing, defamatory, obscene, discriminatory, or harmful to minors;
- send unsolicited marketing to Customers, or use Customer data received through HOPS24 for any purpose other than handling that Customer's inquiry or contract;
- discriminate against Customers on the basis of a characteristic protected by law;
- manipulate reviews, rankings, or availability, or create duplicate or fake listings or accounts.
11. No Guarantee of Inquiries or Results
HOPS24 does not guarantee any number of views, inquiries, bookings, or revenue, or any particular placement of your listings. The Platform may be unavailable at times due to maintenance or events outside our control.
12. Access to Data
In your Provider dashboard you can access data you provide or that is generated by your account: your listings (including CSV export), inquiries and messages from your Customers, bookings you record (with an export), reviews, and statistics on views and inquiries for your listings. HOPS24 has access to all data processed on the Platform as needed for operation, support, security, and abuse prevention, and creates aggregated market statistics without personal information, which may also be offered to Providers. We share Customer contact details only with the Provider the Customer contacted. See our Privacy Policy for details.
13. Suspension and Termination
- You may deactivate listings or request deletion of your account at any time.
- We may remove content or restrict, suspend, or terminate your account for violations of these Provider Terms, the Terms of Service, or the law. Where feasible, we will give you prior notice with the reason and an opportunity to fix the issue. Before permanently terminating a business account, we will generally give 30 days' notice, unless immediate action is required, for example because of fraud, forged safety documents, dangerous listings, content harmful to minors, or a legal obligation.
- We will tell you the reason for any suspension or termination, and you may ask us to review the decision by contacting info@hops24.de.
- Suspension or termination does not affect contracts you have already made with Customers; you remain responsible for performing, changing, or ending them.
14. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless HOPS24 and its affiliates, officers, directors, employees, and agents from and against all claims, liabilities, damages, losses, fines, and expenses, including reasonable attorneys' fees, arising out of or related to: (a) your equipment, services, staff, or entertainers, including any bodily injury, death, or property damage; (b) any contract with a Customer; (c) your Provider Content, including claims of infringement; (d) your failure to obtain required licenses, permits, inspections, or insurance, or to collect and remit taxes; or (e) your violation of these Provider Terms, the Terms of Service, or any law.
15. Disclaimer and Limitation of Liability
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, TO THE FULLEST EXTENT PERMITTED BY LAW.
TO THE FULLEST EXTENT PERMITTED BY LAW, HOPS24 WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, BOOKINGS, DATA, OR GOODWILL. HOPS24'S TOTAL LIABILITY ARISING OUT OF OR RELATED TO THESE PROVIDER TERMS WILL NOT EXCEED THE FEES YOU PAID TO HOPS24 IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. FOR SERVICES PROVIDED FREE OF CHARGE, SUCH AS YOUR FREE PROVIDER ACCOUNT, HOPS24'S LIABILITY IS LIMITED TO THE DAMAGE TYPICALLY FORESEEABLE FOR THIS TYPE OF CONTRACT.
These limitations do not apply to liability for willful misconduct or gross negligence, for death or bodily injury caused by HOPS24, for fraud, or to any other liability that cannot be limited under applicable law.
16. Changes to These Provider Terms
We may change these Provider Terms for legitimate reasons, such as legal, technical, or business changes. We will notify you of changes by email at least 15 days before they take effect, or longer where the changes require significant technical or business adjustments on your part. If you do not agree, you may close your account before the changes take effect. Shorter notice may apply only where required to comply with a legal obligation or to address an unforeseen and imminent danger, such as fraud, malware, or safety risks. New Providers are bound by the version in effect when they register.
17. Governing Law and Disputes
These Provider Terms and any dispute arising out of or related to them or to your use of the Platform as a Provider are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods (CISG). To the extent permitted by law, the courts of Berlin, Germany, have exclusive jurisdiction over all such disputes between you and HOPS24. Mandatory provisions of law that apply to you regardless of this choice of law remain unaffected. These Provider Terms do not contain an arbitration agreement.
