Partner API Terms

These Partner API Terms (the "API Terms") are an agreement between Immobackup UG, Immobackup UG, Dönhoffstraße 11, 10318 Berlin, Germany ("HOPS24," "we," "us," or "our") and the business that registers for or agrees to use the HOPS24 Partner API ("Partner" or "you"). They govern access to the Partner API, API keys, webhooks, and, for Providers, the HOPS24 website widgets and WordPress plugin. Effective date: 2026-10-05.

1. Business Use Only

  • The Partner API is offered only to businesses, organizations, and government entities for commercial or professional purposes, and not to consumers for personal, family, or household purposes. By accepting these API Terms, you represent that you are acting on behalf of a business and are authorized to bind it.
  • Your own terms and conditions do not apply, even if we do not object to them. Our Terms of Service apply in addition to these API Terms where these API Terms do not provide otherwise. Providers are also bound by the Provider Terms.
  • We may decline a registration or suspend access (Section 12), in particular if there is doubt that you are a business.

2. The Service

  • Depending on your plan, the Partner API lets you retrieve public listings of local Providers (search, listing details, availability, categories), submit inquiries from end users to Providers, synchronize data for Providers who link their account to your access ("Provider Integration"), and receive webhook notifications. The current functionality is described in our API documentation.
  • For Providers, a plan also includes the HOPS24 website widgets and WordPress plugin. From the Business plan upward, widgets are shown without the "via HOPS24" notice and include an inquiry form on the Provider's own website.
  • Listing data comes from Providers. HOPS24 does not rent or sell the equipment listed. Contracts for rentals, setup, or purchases are made only between the end user and the Provider; neither HOPS24 nor you become a party to them.
  • Providers may opt out of having their listings shown through the Partner API at any time. The available data may therefore change without notice, and you have no right to any particular listings, Providers, regions, or minimum volume.

3. Plans and Prices

The following plans are currently offered (prices in U.S. dollars, excluding applicable taxes):

  • Free – $0: up to 1,000 requests per calendar month, up to 2 requests per second; read access to listings and availability. Attribution "via HOPS24" required.
  • Starter – $29 per month or $290 per year: up to 25,000 requests per month, up to 10 requests per second; adds inquiry submission and Provider Integration. Attribution "via HOPS24" required.
  • Business – $99 per month or $990 per year: up to 250,000 requests per month, up to 30 requests per second; adds webhooks. No "via HOPS24" notice required (a link to the listing is still required, see Section 6).
  • Partner – from $299 per month: individually agreed quota and features, up to 50 requests per second, and optionally a service level agreement. Partner plans are agreed individually in a separate order form.

Annual billing equals 12 months for the price of 10 (two months free). The current plans and prices are shown on our Partner API page at the time you order; an individually agreed order form takes precedence.

4. Registration, Contract Formation, and API Keys

  • A contract for the Free plan is formed when you confirm your email address after registering an API account, or, for existing Providers, when you first create a key or order a plan. Paid Starter and Business plans are ordered in the API account; the contract for the plan is formed when you complete checkout with Stripe.
  • You receive separate API keys for testing (sandbox with sample data) and live use. You must keep keys confidential, must not place them in publicly accessible code (for example browser scripts without domain restrictions or public repositories), and must not share them with third parties. You are responsible for all use of your keys unless you are not at fault for the misuse.
  • You can revoke and regenerate keys in your API account at any time. If you suspect that a key has been compromised, revoke it immediately; if you cannot, notify us immediately and we will block it.

5. Quotas, Rate Limits, Availability, and Changes to the API

  • Quotas. Your monthly request quota and rate limit depend on your plan. Once your quota is used up, further requests are rejected until the end of the calendar month. There is no automatic paid overage. We notify you by email when you reach 80% and 100% of your monthly quota.
  • Rate limits. You must not exceed or attempt to circumvent rate limits, for example by using multiple accounts or keys.
  • Availability. We aim for high availability but, unless a service level is agreed for a Partner plan, we do not guarantee any particular uptime. We try to perform maintenance outside normal business hours and to announce planned maintenance in advance.
  • Versioning. The API is versioned. We will announce changes that may break existing integrations (for example removing fields or endpoints) at least 30 days in advance by email, unless an immediate change is required for security or legal reasons. Backward-compatible additions may be made at any time.

6. Display Requirements, Attribution, and Caching

  • Link and attribution. You must display every listing obtained through the API with a clearly visible link to its HOPS24 listing page (the listing URL provided by the API). On the Free and Starter plans, you must also display the notice "via HOPS24".
  • Integrity. You must not alter, shorten, or combine listing content in a way that changes its meaning. Prices must be identified as information provided by the Provider; if no price is given, the listing must be shown as "Price on request." You are responsible for ensuring that your own display complies with applicable law, including consumer protection and advertising laws.
  • Caching. You may cache API data for no more than 24 hours, after which you must refresh or delete it.
  • Prohibited uses. You must not: resell, redistribute, sublicense, or otherwise make available API data to third parties (other than displaying it to end users as permitted); build permanent databases from API data; scrape the HOPS24 website outside the Partner API; or use the data to solicit or contact Providers or end users while bypassing HOPS24, including contacting Providers directly instead of using the HOPS24 inquiry process for inquiries originating from your service.

7. Submitting Inquiries

  • You may submit only inquiries that an end user has made personally and at their own request. Automatically generated, fictitious, or unauthorized inquiries are prohibited.
  • Before submitting an inquiry, you must clearly inform the end user that their information will be sent to HOPS24 and the Provider, and obtain the end user's consent. By setting the consent field to true for each inquiry, you confirm that you have done so.
  • You are responsible for collecting the information on your own website or app in compliance with applicable privacy laws. From the moment we receive the inquiry, HOPS24 processes it as described in our Privacy Policy. You do not receive Provider replies through the API, and you are not informed whether the Provider replied; Providers reply to the Customer directly.

8. Provider Integration and Webhooks

  • You may access Provider accounts (synchronizing listings, inquiries, bookings, and blocked dates) only for accounts whose owners have authorized your access. Providers can revoke authorization at any time, and access is then blocked. You may process data received through a Provider Integration only on behalf of and according to the instructions of that Provider.
  • Webhook endpoints must be under your control and reachable via HTTPS. You must verify the signature of each webhook notification. We may disable webhooks after repeated delivery failures.

9. Data Protection and Security

Each party will comply with applicable data protection and privacy laws and maintain reasonable technical and organizational security measures. Where an individual agreement involves processing personal information on the other party's behalf, the parties will enter into an appropriate data processing agreement. Each party will promptly notify the other of security incidents that may affect the other party.

10. Billing, Taxes, and Failed Payments

  • Billing. Starter and Business plans are billed as subscriptions, monthly or annually, through our payment processor Stripe. Fees are due in advance at the start of each billing period and are charged to the payment method you provide at checkout. Subscriptions renew automatically for the same period until canceled under Section 11. We provide invoices electronically through Stripe (by email and in the customer portal). The Free plan is free of charge.
  • Taxes. Prices do not include taxes. Where applicable, sales tax or similar taxes are calculated based on your billing address (via Stripe Tax) and added to your invoice. You are responsible for the accuracy of your billing and tax information, including any tax exemption certificate.
  • Plan changes. You can switch between Starter and Business and between monthly and annual billing in the customer portal. Changes take effect immediately, and amounts already paid are prorated through Stripe as a credit or additional charge.
  • Failed payments. If a payment fails, we will notify you in writing by email. If the amount due remains unpaid 14 days after the due date, we will restrict your access to the Free plan until payment is received; after payment, your paid plan is restored automatically. If Stripe's automatic retry attempts also fail, the paid plan ends and your access continues on the Free plan. Outstanding amounts remain due.
  • Price changes. We may change prices for future billing periods. We will announce price increases by email at least six weeks before they take effect, and you may cancel effective as of the date the increase takes effect.
  • Coupons. Discount or coupon codes apply only as stated.
  • Refunds. Except as required by law or expressly stated in these API Terms, fees already paid are not refundable.

11. Term and Cancellation

  • These API Terms run for an indefinite period. You may cancel a paid plan at any time in the customer portal or by email, effective at the end of the current billing period (month or year). We may cancel a paid plan with the same notice. After a paid plan ends, your access continues on the Free plan.
  • Either party may terminate the entire agreement (including the Free plan) at any time by written notice (email is sufficient); a running paid plan then ends at the end of its billing period.
  • Either party may terminate for cause, for example if you seriously or repeatedly violate Sections 4, 6, 7, or 8 despite a warning.
  • Within seven days after the entire agreement ends, you must delete all data obtained through the Partner API, unless you are required by law to retain it.

12. Suspension

We may temporarily suspend individual keys or your entire access if there are concrete indications of a violation of these API Terms, abuse, a threat to the security or stability of the Platform, or non-payment under Section 10. We will notify you in advance where reasonable, and otherwise promptly afterward, and will lift the suspension once the reason no longer applies.

13. Disclaimer of Warranties

THE PARTNER API, WIDGETS, PLUGIN, DOCUMENTATION, AND ALL DATA ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, HOPS24 DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. Listing data is provided by Providers; we do not warrant its accuracy, completeness, or timeliness, or the actual availability, condition, or safety of any equipment or service.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW: (A) NEITHER PARTY WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL; AND (B) HOPS24'S TOTAL LIABILITY ARISING OUT OF OR RELATED TO THESE API TERMS WILL NOT EXCEED THE FEES YOU PAID TO HOPS24 UNDER THESE API TERMS IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. FOR THE FREE PLAN AND OTHER SERVICES PROVIDED FREE OF CHARGE, HOPS24'S LIABILITY IS LIMITED TO THE DAMAGE TYPICALLY FORESEEABLE FOR THIS TYPE OF CONTRACT.

These limitations do not apply to your payment obligations, your indemnification obligations, your breach of Section 6 or 7, or to liability for willful misconduct or gross negligence, for death or bodily injury, for fraud, or to any other liability that cannot be limited under applicable law.

15. Indemnification

You will defend, indemnify, and hold harmless HOPS24 and its affiliates, officers, directors, employees, and agents from and against third-party claims, and related liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to your breach of Sections 4, 6, 7, or 8, your website or app, or your collection or use of end-user information.

16. Changes to These API Terms

We may change these API Terms for the future where necessary for legal, technical, or business reasons, provided the changes do not unreasonably disadvantage you. We will notify you by email at least six weeks before changes take effect. If you do not agree, you may terminate the agreement effective as of the date the changes take effect; if you continue to use the Partner API after that date, the changes apply. Changes to the core services of a paid plan during a prepaid billing period require your consent.

17. Governing Law and Venue

These API Terms and any dispute arising out of or related to them are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-law rules. The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply. To the extent permitted by law, the courts of Berlin, Germany, have exclusive jurisdiction over all disputes arising out of or related to these API Terms, and both parties consent to the personal jurisdiction of those courts. These API Terms do not contain an arbitration agreement.

18. General

  • Notices under these API Terms may be given by email to the address in your API account or to info@hops24.de.
  • If any provision is held unenforceable, the remaining provisions remain in effect.
  • You may not assign these API Terms without our consent; we may assign them in connection with a merger, acquisition, reorganization, or sale of assets, or to an affiliate.
  • These API Terms, any order form, and the documents referenced in them are the entire agreement regarding the Partner API.
